AvtoVAZ doesn’t admit its monopoly

A preliminary hearing is scheduled for June 27th, wrote the newspaper “Vedomosti”.

AvtoVAZ was included in this register in 1996, and in 2010 it applied to the Federal Antimonopoly Service to reconsider its market share and to exclude from the registry, says the head of the FAS, Maxim Ovchinnikov. FAS conducted a study, and it decided eventually to delete AvtoVAZ from the partition of premium cars, but it has left the plant in the low-cost passenger car segment, where it kept the share of above 35%, the official said. We are talking about the vehicles, which cost up to RUB 600 thousand, he explains. According to FAS, in 2010, the share of Lada in this segment was 47%. AvtoVAZ believes that its share is much less, 35%, said the representative of the plant, but he did not disclose details.

AvtoVAZ produces vehicles in the price range from RUB 279,000 (the minimum recommended retail price of Lada Granta) to RUB 482,100 (Lada Priora Coupe), according to the company website. In 2012, Russia has sold 537,625 Lada cars, total sales of passenger cars were 2.75 million units, according to the AEB. We have no common approach for the assessment of the market share, so it is impossible to predict the end of dispute between AvtoVAZ and FAS, supposes the executive director of the agency AUTOSTAT, Sergei Udalov. The leading lawyer, Sameta Bela Dzgoeva agrees with him: AvtoVAZ should try not dispute about the share, but it should dispute about the method of calculation, which is used by FAS. The size of share is important for AvtoVAZ that the plant is not perceived as a monopoly, said the Director of External Relations of AvtoVAZ, Igor Burenkov.

The presence in the registry makes the company to negotiate with FAS about the preparing mergers and acquisitions, said Mr.Ovchinnikov. In 2012, the Federal Antimonopoly Service approved the creation of the joint venture between “Rostech” and the Renault-Nissan alliance for the receiving of 74.5% of the capital of AvtoVAZ and it ordered the three companies - Renault, Nissan and AvtoVAZ (as well as the structures that is a part of the group) - to inform Service about sales, revenue and pricing of manufactured cars in Russia. The reason of it was the share of Lada, Renault and Nissan cars in the Russian market - over 35%. This requirement is not connected with the order in February for the inclusion of AvtoVAZ in the registry; and if the order will be canceled by the court, then it will not lead to a revision of regulation, underlined Mr.Ovchinnikov.

By the way, in addition to AvtoVAZ, KAMAZ is also in the register, whose share in the segment of “tractors” in the Russian market is estimated in amount of 65%. Perhaps, it is connected with the method of calculation, commented a representative of the plant, Oleg Afanasyev: tractors in the classic version are not the main products of the plant; the share of KAMAZ in this segment does not exceed 10%. According to him, KAMAZ has a share above 40% in the segment of trucks weighing 14-40 tons. Will the plant try to make an exception from the register, he didn’t say. The register includes also GAS - with a share over 65% in the segment of side trucks and with a share less than 65% in the segment of buses of very small class. KAMAZ and GAZ did not apply to the FAS to review the market share, says Mr.Ovchinnikov. If this happens, then the FAS would re-analyze the market, he said. “GAZ Group” is the leader in the segment of buses and light commercial vehicles, and it doesn’t intend to reduce its share of the market. So, we have no reason to exclude companies from this register”, - said the representative of the group.
